fa الزامات حقوق بشری و تعهدات ناشی از حق ثبت ابداعات دارویی بر اساس موافقت‌نامه تریپس: تعارض یا تعامل منافع افراد و دولت‌ها؟ پژوهشي Research <div style="text-align: justify;"><strong><em><span style="font-family:b mitra;"><span style="font-size:11.0pt;">مقدمه:</span></span></em></strong><span style="font-family:b mitra;"><span style="font-size:11.0pt;"> رعایت الزامات حقوق بشری به عنوان قواعد عام‌الشمول در انعقاد موافقت‌نامه‌های بین‌المللی از جمله موافقت‌نامه‌های سازمان تجارت جهانی امری لازم و ضروری است و بر این اساس، تعهد تضمین حق دسترسی به داروهای اساسی به عنوان یکی از استحقاقات و مصادیق حق بر سلامتی که ارتباط معناداری نیز با حق حیات دارد، برای دولت‌ها امری اجتناب‌ناپذیر است.</span></span><br> <strong><em><span style="font-family:b mitra;"><span style="font-size:11.0pt;">مواد و روش ها:</span></span></em></strong><span style="font-family:b mitra;"><span style="font-size:11.0pt;"> تحقیق حاضر با استفاده از روشی توصیفی </span></span><span style="font-size:11.0pt;">&ndash;</span><span style="font-family:b mitra;"><span style="font-size:11.0pt;"> تحلیلی مقررات میثاق بین المللی حقوق اجتماعی، اقتصادی و فرهنگی را در خصوص حق دسترسی به داروهای اساسی به عنوان حقی حقوق بشری که می‌تواند با بحث حمایت از ابداعات دارویی به عنوان یکی از مصادیق حق ثبت اختراع که در موافقت‌نامه تریپس سازمان تجارت جهانی به عنوان جنبه‌ای تجاری از حقوق مالکیت فکری با وصف حقوق خصوصی مورد حمایت قرار گرفته، را بررسی می کند. </span></span><br> <strong><em><span style="font-family:b mitra;"><span style="font-size:11.0pt;">یافته های پژوهش:</span></span></em></strong><span style="font-family:b mitra;"><span style="font-size:11.0pt;"> براساس مقررات موافقت‌نامه تریپس در خصوص حق ثبت اختراع، از جمله مواد 27 و 28، دارنده حق مالکیت فکری حقوقی انحصاری در خصوص ساخت، استفاده، عرضه برای فروش، فروش یا واردات ، پیدا می‌کند که می تواند چالش دسترسی به داروهای اساسی و افزایش قیمت چنین داروهایی را به دنبال داشته باشد و این موضوع به طور خاصی کشورهای در حال توسعه و کمتر توسعه‌یافته را در خصوص تعهد احترام، حمایت و اجرای حق دسترسی به داروهای اساسی را با مشکل مواجه می‌سازد. </span></span><br> <strong><em><span style="font-family:b mitra;"><span style="font-size:11.0pt;">بحث و نتیجه گیری:</span></span></em></strong><span style="font-family:b mitra;"><span style="font-size:11.0pt;"> علاوه بر تمهیدات مندرج در متن موافقت‌نامه تریپس درباره استثناهای محدود و مجوزهای اجباری، تصویب اعلامیه اجلاس دوحه در خصوص موافقت‌نامه تریپس و سلامت عمومی و همچنین صدور تصمیم شورای تریپس در خصوص اجرای مفاد بند 6 این اعلامیه، به عنوان راهکارهای در نظر گرفته شده که عملا تعارض بین مقررات این موافقت نامه&nbsp; و الزامات حقوق بشری را حل و فصل کرده است.</span></span></div> <div style="text-align: justify;"><strong><em>Introduction</em></strong>: The observance of human rights requirements as a general rule in concluding international agreements, such as the WTO agreements, is necessary and, accordingly, a commitment to guarantee the right to access basic medicines as one of the titles and examples of the right to health, which has a meaningful relationship.&nbsp; It also has the right to live which is inevitable for governments.<br> &nbsp;<br> <strong><em>Materials & Methods</em></strong>: The present study uses a descriptive-analytical method to determine the provisions of the International Covenant on Economic, Social, and Cultural Rights on the Right to Access to Essential Medicines as Human Rights, which can be considered as one of the examples of support for pharmaceutical innovations. The patent that is protected by the World Trade Organization&#39;s Trips agreement as a trade-mark of intellectual property rights is protected by the definition of private law.<br> &nbsp;<br> <strong><em>Findings</em></strong><strong>:</strong> Based on the provisions of the Trips Agreement on Patents, including Articles 27 and 28, the holder holds the exclusive intellectual property right to manufacture, use, supply for sale, and sale or import, which can challenge the access to medicines. The underlying cause and the increase in the cost of such drugs, and this in particular, makes it difficult for developed&nbsp; and less developed countries to respect the commitment to support and enforce access to essential medicines.<br> &nbsp;<br> <strong><em>Discussion & Conclusions</em></strong><strong>:</strong> In addition to the provisions of the Trips Agreement on limited exceptions and compulsory licenses, the approval of the Doha Summit Declaration on the Trips and Public Health Agreements, as well as the issuance of the Trips Council Decision on the implementation of the provisions of paragraph 6 of this Declaration, are considered as solutions.
